New Hampshire Law Allows Witnesses During Workers Compensation
Examination
July 15, 2010 - Beginning January 1, 2011,
New Hampshire law (H.B. 1371) will allow an
injured employee who files a workers' compensation
claim shall have the right to have a witness present during
independent medical examinations.
The witness may take notes and observe on behalf of the injured
employee but may not interfere with the exam in any way. The
injured employee will be required to sign an authorization document
indicating that they understand that his or her medical history
will be discussed and waive any privacy rights by voluntarily
allowing the witness to attend the exam on his or her behalf.
